The Patent, Design and Trademark Act, 1965 governs and deals with the mechanism of Patent Protection in Nepal.

Process Patent and Product Patent are the two types of Patent Protection available in Nepal.

The following are the types of Patent Applications:

• Non-Convention Application
• Convention Application
• Divisional Application
• Patent of Addition

In Nepal, the Patent Protection is available for 20 years.

The Time Frame for Examination from the Date of Application is 12-25 months approximately and the Time Frame for Publication from the Date of Acceptance is within 1 month approximately.

In Nepal, an Opposition against a Patent Application can be raised at the pre-grant stage anytime after the Patent grant.
