In India, the Trademark Act of 1999 presents a legal basis for dealing with the mechanism of registration and protection of the trademark.

The types of the Trademark registered and protected can be categorized as follows:

  • CONVENTIONAL TRADEMARKS including word mark, device mark, collective mark and certification mark.
  • NON-CONVENTIONAL TRADEMARKS including 3-D mark, sound mark, color mark, slogan mark and shape mark.
  • WELL-KNOWN TRADEMARKS

In India, the 11th edition of Nice Classification is accepted by the Trademark office.

The Opposition Period for the trademark in India is four months from the Date of Publication of the Trademark in the Official Gazette.

Upon registration, the Trademark Protection is available for ten years from the Date of Application, renewable every ten years on payment of the required fee.

In India, the Grace Period for Trademark Renewal is six months, and the Non-Use Cancellation Period is five years from the Date of Registration.
